Terms of service

1. Acceptance of terms

ConePic ("the Service") is operated by Digibuffer Private Limited, a company registered in India ("we", "us"). By accessing and using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of service

ConePic lets photographers deliver photos and videos to their clients in online galleries, with album picks, comments, downloads, face scan, watermarks and a public studio page.

Files you upload to ConePic are stored in your StorageCone account, which is a separate service from the same company with its own terms. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Account registration

You sign in with a Cone ID, the account shared by ConePic and StorageCone. To use the Service, you must:

• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities under your account

4. Your clients and guests

You decide who can open your galleries. When you invite clients and guests, you are responsible for having the right to share the photos with them, and for telling them that you deliver photos through ConePic. If you turn on face scan, you are responsible for letting guests know that a selfie is used to find their photos.

5. Acceptable use

You agree not to:

• Upload illegal, harmful, or infringing content
• Violate any intellectual property rights
• Attempt to gain unauthorized access to our systems
• Use the Service for any unlawful purpose
• Distribute malware or engage in phishing
• Abuse, harass, or harm other users
• Interfere with the proper functioning of the Service

6. Content ownership and license

You retain all ownership rights to the content you upload. By uploading content, you grant ConePic a limited license to:

• Store and process your content to provide the Service
• Create previews, watermarked copies and face data for the features you turn on
• Display your content to the people you share it with
• Make backup copies for data protection purposes

This license ends when you delete the content or close your account.

7. Subscription and payment

Paid subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees. Prices are subject to change with 30 days notice. Storage is billed by StorageCone. Refunds are provided according to our refund policy.

8. Free gallery

The free gallery is open for the number of days shown when you create it. After that, clients see a closed page until you choose a paid plan.

9. Data backup and loss

While we maintain backup systems, you are responsible for maintaining your own backups. We are not liable for any data loss, except as required by law. We recommend keeping copies of important photos in multiple locations.

10. Termination

You may cancel your plan at any time in Plan & settings. We may suspend or terminate your account if you:

• Violate these Terms of Service
• Fail to pay applicable fees
• Engage in fraudulent or illegal activity
• Pose a security risk to our systems or other users

11. Intellectual property

The ConePic service, including its software, design, and branding, is protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service without permission.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONEPIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify and hold ConePic harmless from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

15. Dispute resolution

We will first try to resolve any dispute with you informally: write to us and we will respond within 30 days. Any dispute that is not resolved this way shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Hyderabad, Telangana, and the proceedings shall be in English.

16. Governing law

These terms are governed by the laws of India. Subject to the arbitration clause above, the courts at Hyderabad, Telangana have exclusive jurisdiction.

17. Changes to terms

We may modify these terms at any time. We will notify you of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the new terms.
